Man accused of throwing urine-filled cup at corrections officer wants to avoid jail - WHIO

The lawyer for a man charged with throwing a urine-filled container on a jail officer made a surprising request ahead of his client’s Wednesday court hearing.

News Center 7’s Mike Campbell was in Montgomery County Common Pleas Court for Elijah G. Cannon’s case.

Facing harassment by an inmate charges, 40-year-old Cannon did not appear pleased to see News Center 7, and repeatedly flipped off the camera.

The Montgomery County Sheriff’s Office released video that shows corrections officers move Cannon right after the Dec. 4, 2019, incident.

Sheriff Rob Streck said Cannon threw the cup of urine while a deputy was distracted by another inmate. Cannon then tried to throw a second container, and officers had to use a Taser to get Cannon to put down the cup, the sheriff said.

Cannon’s lawyer filed a motion for intervention in lieu of conviction, with no jail time. This is not a usual request in such a case.

Meanwhile, at the jail, Streck said employees have come up with a bodily fluids shield to protect jail employees from inmates they know to pose this type of threat, and he said they will have a no tolerance policy.

“We’re going to enforce the laws inside the jail and make it the safest place that we can,” he said.

Cannon remains in the Montgomery County Jail on a $250,000 bond. His next court date is Feb. 12, but it’s not clear whether he’ll find out then if he can be admitted into an intervention program.
